    <Abstract>&lt;p&gt;In today's world, fundamental human rights play a crucial role in private law, particularly in contract law, to the extent that the content of contracts must comply with these rights. The impact of fundamental human rights on private contracts occurs both directly and indirectly. In the direct effect approach, fundamental human rights directly influence contractual relationships. The primary criticism of this approach is that it undermines the independence of private law. In contrast, the indirect effect of fundamental human rights manifests through the interpretation of contractual rules. A key advantage of this approach is the preservation of the autonomy of private law as a distinct legal discipline, which is favored by positivists. In this article, the author adopts a descriptive-analytical method to elucidate the concepts related to the proposed models, critique each approach, and briefly examine Iran's judicial practice in this regard.&lt;/p&gt;</Abstract>
